If a customer is injured due to the contractor’s work in July 2024 but doesn’t file a claim until 2026, the claim is still covered because the incident occurred during the policy period.

Claims-made Policy
A claims-made policy is a type of insurance coverage that provides protection only if the claim is made during the active policy period (or within an extended reporting period, if purchased)—regardless of when the incident occurred, as long as it happened after a specified retroactive date.
A consultant has a claims-made professional liability policy effective from January 1, 2024, to December 31, 2024, with a retroactive date of January 1, 2023. If a client files a claim in November 2024 for an error the consultant made in February 2021, the policy covers it—because:
- The incident happened after the retroactive date, and
- The claim was made during the policy period.
But if that same claim is filed in January 2025 (after the policy ends), it would not be covered—unless the consultant has purchased tail coverage (an extended reporting period).
